Zusammenfassung In early modernity, church historians initially showed little interest in Berthold of Moosburg. They knew him as a commentator of Proclus, but they did not recognise his importance for the history of Neoplatonism. The librarians and bibliographers who came across Berthold’s commentary on Proclus in the Balliol College Library at Oxford showed no interest in the philosophical content of this work. An article on Berthold in the monumental work Scriptores Ordinis Praedicatorum summarised the available information. It was Johann Albert (...) Fabricius who took notice of it. Fabricius was very interested in Proclus as well as in Neoplatonic theology and its narration in the Elements of Theology; he had started to collect all available information regarding this issue and had also come across Berthold’s commentary. However, he did not ignore him, as many had done before, but properly recognised the importance of Berthold for the history of the reception of Proclus’s philosophy. Fabricius always referred to the Dominican thinker when dealing with Proclus’s Elements of Theology, in particular in his own Bibliotheca graeca. One of the attentive readers of this work was the German philologist Friedrich Creuzer. In 1822, within the framework of publishing Neoplatonic writings, Creuzer reedited Proclus’s Elements of Theology. As a consequence of this new edition, Proclus together with his medieval commentator came into the focus of leading representatives of classical German philosophy. (shrink)

This paper makes a conceptual inquiry into the notion of ‘publics’, and forwards an understanding of this notion that allows more responsible forms of decision-making with regards to technologies that have localized impacts, such as wind parks, hydrogen stations or flood barriers. The outcome of this inquiry is that the acceptability of a decision is to be assessed by a plurality of ‘publics’, including that of a local community. Even though a plurality of ‘publics’ might create competing normative demands, its (...) acknowledgment is necessary to withstand the monopolization of the process of technology appraisal. The paper presents four ways in which such an appropriation of publicness takes place. The creation of dedicated ‘local publics’, in contrast, helps to overcome these problems and allows for more responsible forms of decision-making. We describe ‘local publics’ as those in which stakeholders from the different publics that are related to the process of technology implementation are brought together, and in which concerns and issues from these publics are deliberated upon. Knowing that technologies are inherently value-laden and systemically interwoven with society, the question is how individual engineers can take up the challenge of accepting the responsibility for their work? This paper will argue that engineers have no institutional structure at the level of society that allows them to recognize, reflect upon, and actively integrate the value-laden character of their designs. Instead, engineers have to tap on the different institutional realms of market, science, and state, making their work a ‘hybrid’ activity (...) combining elements from the different institutional realms. To deal with this institutional hybridity, engineers develop routines and heuristics in their professional network, which do not allow societal values to be expressed in a satisfactory manner. To allow forms of ‘active’ responsibility, there have to be so-called ‘accountability forums’ that guide moral reflections of individual actors. The paper will subsequently look at the methodologies of value-sensitive design and constructive technology assessment and explore whether and how these methodologies allow engineers to integrate societal values into the design technological artifacts and systems. As VSD and CTA are methodologies that look at the process of technological design, whereas the focus of this paper is on the designer, they can only be used indirectly, namely as frameworks which help to identify the contours of a framework for active responsibility of engineers. This article provides an analysis of moral emotions from an attributional point of view, guided by the metaphors of man as a naïve scientist (Heider, 1958) and as a moral judge (Weiner, 2006). The theoretical analysis focuses on three concepts: (a) The distinction between the actor and the observer, (b) the functional quality of moral emotions, and (c) the perceived controllability of the causes of events. Moral emotions are identified (admiration, anger, awe, contempt, disgust, elevation, embarrassment, envy, gratitude, guilt, indignation, (...) jealousy, pity, pride, rage, regret, remorse, resentment, respect, schadenfreude, scorn, shame, and sympathy). A classification of these moral emotions is suggested and the empirical evidence briefly summarized. In discussing our results, we identify unresolved issues awaiting further analyses and research. We develop and use an integrated individual-level model to explain the driving forces behind digital piracy practice in two nations. The proposed model combines the Norm Activation model and Unified Theory of Acceptance and Use of Technology models. This study also explores the effect of culture on intention to practice DP in two nations: US and India. A survey instrument was used to collect data from 231 US and 331 Indian participants. Use of the integrated model proves to be a (...) powerful and a viable approach to understanding DP across cultures. In each nation, all 10 path coefficients on the research model are statistically significant thereby establishing the fact that personal norm, together with other factors, influences INT to engage in DP, which in turn, may influence the actual practice. The results reveal a support for cross-cultural generalizability and applicability of the proposed model. Culture clearly plays a strong moderating role in two out of the three paths tested. New network technologies are framed as eliminating ‘transaction costs’, a notion first developed in economic theory that now drives the design of market systems. However, the actual promise of the elimination of transaction costs seems unfeasible, because of a cyclical pattern in which network technologies that make that promise create processes of institutionalization that create new forms transaction costs. Nonetheless, the promises legitimize the exemption of innovations of network technologies from critical scrutiny.

Emotions are often met with suspicion in political debates about risky technologies, because they are seen as contrary to rational decision making. However, recent emotion research rejects such a dichotomous view of reason and emotion, by seeing emotions as an important source of moral insight. Moral emotions such as compassion and feelings of responsibility and justice can play an important role in judging ethical aspects of technological risks, such as justice, fairness, and autonomy. This article discusses how this idea can (...) be integrated into approaches for political decision making about risk. The article starts with an analysis of the dichotomous view of reason and emotion in risk theory, in approaches to participatory risk assessment as well as in relevant approaches to political philosophy. This article then presents alternative approaches in political philosophy and political theory that do explicitly endorse the importance of emotions. Based on these insights, a procedural approach for policy making is presented, in which emotional responses to technological risks, and the ethical concerns that lie behind them, are taken seriously. This approach allows for morally better political decisions about risky technologies and a better understanding between experts and laypeople. (shrink)

Between Wolff and Kant: Merian's Theory of Apperception UDO THIEL IT IS WELL KNOWN that the nodon of apperception or self-consciousness is central to Kant's theoretical philosophy. Kant introduces the notion in one of the crucial parts of the Critique of Pure Reason, the Transcendental Deduction of the Categories, and assigns it an important role in his critique of traditional metaphysics of the soul in the Transcendental Dialectic.' It is also well known that Kant did not invent the term "apperception." (...) Leibniz had introduced the French 'Tapperception" into philosophical terminology early in the eigh- teenth century. Kant scholars generally stress, rightly, that Kant's notion of apperception differs significandy from that of his predecessors. However, the precise relation between Kant's concept of apperception and earlier accounts has not been considered in any detail. Wolfgang Carl, for example, simply states that the main difference is that, prior to Kant, apperception was under- stood as relating only to mental acts and their contents, and not to the subject that thinks and has ideas, whereas in Kant apperception relates essentially to the thinking subject. 2 This very general thesis is questionable even in regard to some of the philosophers that Carl cites in this context . This article provides a critical overview of the most important issues pertaining to the ongoing debate on international research ethics. It critically describes three problems of continuing concern: 1) the question of whether the distinction between therapeutic and non‐therapeutic research should be upheld; 2) the questions of whether the currently demanded best proven diagnostic and therapeutic method of treatment for all research subjects is feasible both in developed and in developing countries, and whether it should be upheld; 3) the questions (...) of who owns international research ethics guidelines and regulatory frameworks and, how decisions about changes to such international guidelines can possibly be achieved, given that it seems to be the case that genuine disagreement about issues of content is possible and likely. This paper questions Hegel’s critique to the central place that Romantic authors Friedrich Schlegel andNovalis gave to the dimension of affection in their philosophical thinking, as well as to the way theylink philosophy and poetry. The summit of this affective and poetical tendency of the Romantics is theso-called Sehnsucht – the infinite longing or aspiration – which Hegel criticizes in a very truculentmanner. The interest of this debate is not limited to the studies on the famous controversy Hegelversus Romanticism; in (...) a broader sense, it presents a singular case of a certain dissent on the way howphilosophy takes a stand on the matter of affection and poetry. In Hegel’s case, this stand is one thatposes a strong hierarchy in which reason and the conceptual activity of thinking are superior to thedimension of feelings, and this hierarchy also unfolds as a superiority of the philosophical over thepoetical – while the Romantics endeavoured, precisely, to unravel such hierarchy. This paper defendsthe importance and deepness of the affective dimension promoted by the Romantics, whilst alsoattempts to deconstruct some of the main assumptions of Hegel’s critique. (shrink)

Despite the opening of the market and partial privatization of state‐owned companies in China, the state still represents the controlling shareholder in larger companies. By analyzing the weaknesses of Chinese corporate governance we illustrate the framework for harmful corruption. China is characterized by a weak legal system and strong influences of traditions such as guanxi. In this article we analyze the influence of guanxi on the Chinese corporate governance system. We find that guanxi is in general a double‐edged sword, but (...) business‐to‐government guanxi in particular can harm the weak Chinese corporate governance system and hamper its further economic development and growth. Die Sphäre des Unbewussten und die der Repräsentation sind miteinander radikal inkompatibel. Grave nahm entscheidenden Einfluss auf wichtige Debatten, Kontroversen und Forschungsentwicklungen seiner Zeit; so entwickelte er Vorformen soziologischen Forschens und Argumentierens. The question of whether problems with the social determinants of health that might impact decision-making justify denying eligibility for assisted dying has recently come to the fore in debates about the legalisation of assisted dying. For example, it was central to critiques of the 2021 amendments made to Canada’s assisted dying law. The question of whether changes to a country’s assisted dying legislation lead to descents down slippery slopes has also come to the fore—as it does any time a jurisdiction (...) changes its laws. We explore these two questions through the lens of Canada’s experience both to inform Canada’s ongoing discussions and because other countries will confront the same questions if they contemplate changing their assisted dying law. Canada’s Medical Assistance in Dying law has evolved through a journey from the courts to Parliament, back to the courts, and then back to Parliament. Along this journey the eligibility criteria, the procedural safeguards, and the monitoring regime have changed. In this article, we focus on the eligibility criteria. First, we explain the evolution of the law and what the eligibility criteria were at the various stops along the way. We then explore the ethical justifications for Canada’s new criteria by looking at two elements of the often-corrosive debate. First, we ask whether problems with the social determinants of health that might impact decision-making justify denying eligibility for assisted dying of decisionally capable people with mental illnesses and people with disabilities as their sole underlying medical conditions. Second, we ask whether Canada’s journey supports slippery slope arguments against permitting assisted dying. All data relevant to the study are included in the article. (shrink)

ABSTRACT Most pharmaceutical research carried out today is focused on the treatment and management of the lifestyle diseases of the developed world. Diseases that affect mainly poor people are neglected in research advancements in treatment because they cannot generate large financial returns on research and development costs. Benefit sharing arrangements for the use of indigenous resources and genetic research could only marginally address this gap in research and development in diseases that affect the poor. Benefit sharing as a strategy is (...) conceptually problematic, even if one, as we do, agrees that impoverished indigenous communities should not be exploited and that they should be assisted in improving their living conditions. The accepted concept of intellectual property protection envisages clearly defined originators and owners of knowledge, whereas the concept of community membership is fluid and indigenous knowledge is, by its very nature, open, with the originator(s) lost in the mists of time. The delineation of ‘community’ presents serious conceptual and practical difficulties as few communities form discrete, easily discernable groups, and most have problematic leadership structures. Benefit sharing is no substitute for governments’ responsibility to uplift impoverished communities. Benefit sharing arrangements may be fraught with difficulties but considerations of respect and equity demand that prior informed consent and consultation around commercialisation of knowledge take place with the source community and their government.1. Apoptosis is a physiological mechanism for the removal of unwanted or damaged cells. Apoptotic cells are rarely seen in living tissues, however, because of their rapid and efficient removal by phagocytosis. Phagocytotic cells such as macrophages or dendritic cells recognize apoptotic cells by specific changes of cell surface markers, which usually are not present on normal cells. One such event is the exposure of phosphatidylserine, which moves from the plasma membrane inner leaflet to the outer leaflet in preapoptotic cells. An (...) unresolved problem, however, was the nature of the phosphatidylserine receptor on the phagocytotic cells. In a recent issue of Nature, Fadok et al.(1) have reported the cloning of a phosphatidylserine receptor using an antibody raised against activated macrophages. The way pollution is managed in Western countries is based on the preservation of the taboo character of waste, which is conceived to be privately produced and seen as a threat to public health. Public authorities have been given the responsibility to isolate waste and hide it from public eyes. However, this dominant approach is challenged by the emergence of new forms of pollution. New conceptual and policy frameworks to manage environmental degradation have to be developed. Today's clinical AIDS research is in trouble. Principal investigators are confronted with young and frequently highly knowledgeable patients. Many of these people with AIDS are often unwilling to adhere to the trial protocols. These PWAs believe they are ethically justified in breaching trial protocols because they do not consider themselves true volunteers in such trials. PWAs argue that they do not really volunteer because existing legislation prevents them from buying and using experimental drugs or from testing alternative treatment strategies.
